General terms and conditions of Sophistique Jewelery

§1 Scope
(1) The following general terms and conditions apply to all deliveries between us and a consumer in the version valid at the time of the order.

§2 Conclusion of a contract, storage of the contract text

§3 Prices, shipping costs, payment, due date
(1) The prices stated include statutory sales tax and other price components. In addition, there are any shipping costs.

(2) The consumer has the option of paying via PayPal, credit card (Visa, Mastercard, American Express).

§4 Delivery
(1) Unless we have clearly stated otherwise in the product description, all items we offer are ready for immediate dispatch. Delivery takes place within 5 working days at the latest. In the case of payment in advance, the deadline for delivery begins on the day after the payment order is sent to the bank responsible for the transfer and, for all other payment methods, on the day after the contract is concluded. If the deadline falls on a Saturday, Sunday or public holiday at the delivery location, the deadline ends on the next working day.

(2) The risk of accidental loss and accidental deterioration of the item sold, even in the case of a mail order purchase, only passes to the buyer when the item is handed over to the buyer.

§5 Retention of title
We reserve ownership of the goods until the purchase price has been paid in full.

§9 Returns and complaints

1) A refund is only possible if the goods are in their original condition with no signs of wear. A refund of the purchase amount is only possible within 30 days of receipt of the goods.

2) If we receive a return after 30 days and a refund is no longer possible, we reserve the right to send the goods back to the sender at the sender's expense.

3) Before your order is shipped, we check each piece of jewelry for quality and integrity. If you still receive a defective piece of jewelry, we will of course exchange it for a new and flawless piece of jewelry free of charge. 2) If a product has a defect within the first 6 months after purchase that was already present at the time of purchase and that is not due to your own fault or natural wear and tear, there is the option of receiving a replacement product. Our customer service will be happy to examine your request individually.

3) To ensure that your jewelry stays shiny and beautiful for as long as possible, we have put together a care guide for you here. After the 6 months, our jewelry is excluded from claims. Possible discoloration or product defects after this time are usually due to natural wear and tear.

§9 Liability
We always have unlimited liability for claims due to damage caused by us, our legal representatives or vicarious agents
• in the event of injury to life, body or health
• in the event of intentional or grossly negligent breach of duty
• in the case of guarantee promises, if agreed, or
• as far as the scope of application of the Product Liability Act is open.
In the event of a breach of essential contractual obligations, the fulfillment of which is essential for the proper execution of the contract and on whose compliance the contractual partner can regularly rely, (cardinal obligations) due to slight negligence on the part of us, our legal representatives or vicarious agents, the liability is limited to the amount foreseeable at the time the contract was concluded Damage that typically has to be expected is limited.
